Curetech Innovative Therapies and/or its affiliates ("Curetech", "we" or "us") operate an online store ("Curetech Shop") at shop.curetech.com, where you can purchase our products and services ("Curetech Shop Products"). These Terms of Use govern your access to and use of the Curetech Shop and Curetech Shop Products. They do not cover products or services available under other terms, such as our therapy services governed by the Curetech Services Agreement.
- Information You Provide
When visiting the Curetech Shop, you may supply personal information. Our Privacy Policy details how we manage that information. We may contact you via email or text for identity verification or important updates. By providing your contact details on the Curetech Shop, you agree to receive such communications (standard text or data charges may apply). Where offered, you may disable text notifications by replying "STOP" or following the provided instructions. Please note that disabling these notifications could limit security features and increase risk. - Curetech Shop Intellectual Property
Curetech and its licensors exclusively own all patents, copyrights (and rights to derivatives), moral rights, rights of publicity, trademarks, service marks, logos, designs, trade secrets, and other intellectual property ("Curetech Shop IP") in the Curetech Shop. The Curetech Shop IP is protected by applicable laws. Any rights not expressly granted in these Terms of Use remain reserved. If you submit comments or ideas ("Ideas") regarding improvements to the Curetech Shop or our offerings, your submission is considered voluntary and unrestricted. You agree that Curetech is free to use such Ideas without any obligation of attribution or compensation. - Access to the Curetech Shop
Curetech grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Curetech Shop. This license does not include rights to use any content, information, or product listings beyond what is expressly permitted. Use of our logos is governed by our Marks Usage Agreement; unauthorized use terminates your permission. - Products, Content, and Specifications
Product and service details available for purchase in the Curetech Shop ("Curetech Shop Products") are described within the store. All features, content, specifications, products, and prices may change at any time without notice. We provide weights, measures, and similar descriptions as approximations only. Packaging may vary, and actual product appearances might differ from what you see on the Curetech Shop due to display limitations. Availability of products or services at a given time does not ensure future availability. Should manufacturing or distribution delays occur, we will notify you and update the delivery schedule. By placing an order, you confirm that the products will be used in compliance with all applicable laws. - Subscriptions
a. Subscription Terms
We may offer subscriptions through the Curetech Shop. Subscription-specific terms will be provided at or before purchase. By purchasing a subscription, you agree to those terms.
b. Free Trials and Promotional Periods
If a subscription starts with a free trial or promotional period, you have the right to cancel before the trial or period ends. If no online cancellation option is available, you may cancel by contacting us. We will send a reminder before the trial or promotional period concludes, giving you the opportunity to cancel. If no cancellation is made, billing will commence at the end of the trial or promotional period, and further cancellation rights will be subject to the subscription's specific terms.
c. Cancellation
The process and rights for canceling your subscription will be disclosed at or before the time of purchase.
- Your Account
Access to the Curetech Shop, including making purchases, may require account creation. You agree to provide accurate, current information and to update us if any information changes. You are responsible for maintaining the confidentiality of your account and login details, and for all activities under your account. We reserve the right to terminate your account at any time, for any reason. - Shipping and Returns
This section applies to physical goods sold through the Curetech Shop. Orders are shipped via carriers chosen by Curetech, and any shipping fees will be disclosed prior to order confirmation. Estimated shipping dates are provided for convenience but are not guaranteed; delays may occur due to inventory shortages or events beyond our control. Curetech is not liable for delays, damages, or losses resulting from shipping issues. Unless noted otherwise, each Curetech Shop Product is delivered FCA (Incoterms 2010) at the designated delivery location.
Unless otherwise specified, physical products may be returned in their original condition, with all accessories, within 30 days of purchase. Refunds are issued only if the delivered product does not match its description. In such cases, your remedy is to return the unused product for a full refund. Contact us to initiate the return process and receive return shipping instructions. Curetech will cover the cost of return shipping.
- Sanctions and Export Policy
You may not use the Curetech Shop or purchase any Curetech Shop Products for use in or on behalf of any country, organization, entity, or person subject to government embargoes or sanctions, including those designated by the United States Office of Foreign Asset Control (OFAC). We do not guarantee that the Curetech Shop or any product will comply with all export, import, or foreign use laws. - No Warranties
The Curetech Shop, its IP, and its products are provided "as is" and "as available," without warranties of any kind—express, implied, or statutory. Curetech does not guarantee the accuracy or reliability of any data on the Curetech Shop, that products will meet your needs, that the site will be continuously available or secure, or that defects will be corrected. Use of any data, products, or services is at your own risk. Nothing herein is intended to limit any rights or remedies to the extent prohibited by law. - Limitation of Liability
Under no circumstances shall Curetech be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages resulting from your use or inability to use the Curetech Shop, or from delays, loss of profits, personal injury, or property damage—even if advised of the possibility of such damages. Curetech disclaims liability for any damages arising from hacking, unauthorized access, failure to maintain adequate security measures, non-compliance with our instructions, or the presence of bugs or harmful code. Your liability, if any, is limited to direct, documented damages and shall not exceed the greater of the total amount paid to Curetech in the three months prior to the incident or USD $20. - Disputes
a. Binding Arbitration
Any dispute, claim, or controversy arising from these Terms of Use—including issues related to statutory or common law claims, breach, termination, enforcement, interpretation, or validity—will be resolved by binding arbitration in Louisville, Kentucky, before a single arbitrator, except for disputes primarily concerning intellectual property, which will be resolved in litigation before the appropriate federal court. Arbitration will be administered by the American Arbitration Association under its Commercial Arbitration Rules, with expedited procedures applying as applicable. The arbitrator will apply the substantive law of the State of Kentucky. If necessary, either party may petition a federal court in Louisville to appoint an arbitrator if the American Arbitration Association is unavailable. This provision does not preclude either party from seeking provisional remedies in aid of arbitration.
Either party may initiate arbitration by submitting a written demand to the American Arbitration Association and notifying the other party, detailing the dispute and requested relief.
b. Service of Process
Each party consents to service of process at its corporate headquarters or registered address, without limiting other legally permissible methods.
c. Class Waiver
To the fullest extent permitted by law, any dispute under these Terms of Use will be resolved solely on an individual basis, not as part of a class or representative action. Both parties waive the right to a jury trial for any such disputes.
d. Provision of an Award
Subject to these Terms and applicable law, the arbitrator may award monetary damages and other remedies allowed under Kentucky law. The arbitrator’s decision ("Award") will be provided in a written, reasoned format that is final and binding, and may be confirmed or enforced in a Louisville federal court.
e. Fees
Each party will initially bear half of the arbitrator’s fees, the costs of the arbitration reporter, and facility fees. The arbitrator may award reasonable attorneys’ fees and costs to the prevailing party, with any opposing awards offset as necessary.
f. Confidentiality
All parties agree to maintain the confidentiality of the arbitration proceedings, the hearing, and the Award, except as required to conduct the arbitration, enforce an Award, engage in settlement negotiations, or as otherwise mandated by law.
g. Conflict of Rules
In the event of any conflict between this Section and the applicable arbitration rules, these Terms shall prevail. If any arbitration provision is found invalid or unenforceable, the remaining provisions will continue in full force.
- Applicable Law
By using the Curetech Shop, you agree that the laws of the State of Kentucky, USA—without regard to conflicts of law principles—will govern these Terms of Use and any disputes arising between you and Curetech. - Modification and Severability
We may modify these Terms of Use at any time with prospective effect. Any changes will be posted on our website or another platform we control. The current version is always available on our website, with the "Last updated" date indicating the most recent revision. - Our Address
